Emergency Medical ("Emergency Medical") knows you care about how your information is used and shared. We take protecting your privacy very seriously. Please read the following to learn more about how we use and protect information collected through the Emergency Medical Alert App (the "App"). This App is for friends and family (the "Caregiver(s)") to use to monitor and receive information about a loved one who uses one of Emergency Medical's hardware monitoring devices ("Wearer"). This App is not intended to be used by professional caregivers or in a commercial setting.

BY USING THE APP OR BY OTHERWISE GIVING US YOUR INFORMATION, YOU AGREE TO THE TERMS OF THIS PRIVACY POLICY. Please review this Privacy Policy carefully. If you do not agree to this Privacy Policy, do not use the App. We may update this Privacy Policy to reflect changes to our information practices. Any changes will be effective immediately upon the posting of the revised Privacy Policy. We will provide notice of material changes by push notifications to your device or by other means prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.

This Privacy Policy covers our treatment of information provided to us by you, through your use of the App and the Wearer's use of one of Emergency Medical's hardware monitoring devices, this may include your personally identifiable information and the personally identifiable information of the Wearer ("Personal Information"). This Privacy Policy does not apply to the practices of companies or institutions that we do not own or control, or to individuals that we do not employ or manage. Your use of the App will allow you to provide us with your Personal Information as well as the Wearer's Personal Information, including but not limited to information about the Wearer's health, physical activity, and physical fitness. The App collects your Personal Information for the purposes of maintaining information about the Wearer for ready access for all Caregivers of the Wearer. If you choose to use the App to provide us with the Wearer's Personal Information, you must have the Wearer's consent. By providing the Wearer's Personal Information, you hereby warrant that you have the Wearer's consent to do so and we are not liable for any use thereof, provided it is in accordance with this Privacy Policy.

We do not knowingly collect or solicit Personal Information from anyone under the age of 18 or knowingly allow such persons to register for the App. If you are under 18, you must not attempt to register for the App and you must not send any information about yourself or the Wearer to us, including but not limited to your name, address, telephone number, or email address. In the event that we learn that we have collected Personal Information from a person under age 18, we will delete that information. Information Collected by the App.  

The App will obtain information from you in two ways: (1) information that you manually enter into the App, and (2) information collected automatically about the Wearer or the Caregiver.

When you use the App, information collected about the Wearer and how they use their monitoring device may include, but is not limited to:

 

 

 

When you use the App, we and our business partners may collect certain information about your device through technology such as cookies, web beacons, log files, or other tracking or recording tools. The information we collect through the use of tracking technologies includes, but is not limited to, IP address, browser information, referring and exit pages and URLs, click stream data and how you interact with links in the App, domain names, landing pages, page views, cookie data that allows us to uniquely identify your browser, browsing behavior on our site, mobile device type, mobile device IDs or other persistent identifiers, and location data collected from your device. However, some features of the App may not function properly if the ability to accept cookies is disabled. Security of Personal Information.  

We care about the security of your Personal Information and the Wearer's Personal Information and we use reasonable and appropriate physical, administrative, and technological safeguards to preserve the integrity and security of all Personal Information we collect and that we share with our service providers. However, no security system is impenetrable and we cannot guarantee the complete security of our systems. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Access to the App on your device is protected by biometric security (e.g., Touch ID) or the passcode you selected after you downloaded the App. You should take steps to prevent unauthorized access to your account and Personal Information by selecting and protecting your biometric security and passcode appropriately and limiting access to your device.

The App contains links to third party websites. We are not responsible for the privacy policies or practices on websites that may be accessed through these links. When following a link to another website, you should read that website's Privacy Policy and make sure that you agree with it and can abide by it.

Please note that all information collected by the App will be processed in the United States, and this may be done by another entity under contract with Emergency Medical. You should only transmit data if you are in the United States at the time you transmit such data. You should be aware that the laws in the United States may not protect your privacy to the same extent as the laws in the country from which you have transmitted data to the App.

Sharing of Your Information  

We will not rent or sell your Personal Information to third parties outside of our controlled subsidiaries and affiliates without your consent, except as noted below:

 

 

 

 

 

Choices About Your Information.  

You may, of course, decline to submit any Personal Information through the App, in which case we may not be able to provide the in-App services to you or the Wearer.

 

 

 

Your California Privacy Rights  

We collect various types of Personal Information about you and the Wearer through the App, as described in this Privacy Policy. Under California law, Emergency Medical customers who are residents of California may request certain information about our disclosure of Personal Information during the prior calendar year to third parties for their direct marketing purposes.
